New York divorce law

Although No-Fault divorce is available in New York (after a separation of one year under the terms of a separation agreement or order), New York continues to have fault-based divorce and call it divorce. So someone seeking a divorce in New York may plead adultery, abandonment for one year, imprisonment for 3 years or more, or cruel and inhuman treatment. All of these grounds are most often used if only one party to the marriage wants a divorce, or if the parties are arguing over child support or custody.
